Learned counsel for the appellant submits that a settlement has been arrived at between the parties as already recorded vide order dated 28.11.2023. He further submits that the requisite payments in terms of the MOU have also been made and consequently the respondent has withdrawn the pending execution petition.

In view of the aforesaid, learned counsel for the appellant seeks to withdraw the present RFA; the same is accordingly dismissed as withdrawn. 3.
