The learned senior counsel appearing on behalf of the petitioner states that the application filed for condonation of delay by the respondents herein has not been decided by the learned Trial Court and the learned Trial Court without deciding that application has continued the trial. 2.

However, the learned counsel appearing for the respondents states that he has no objection if the case is sent back with direction to the learned Trial Court to decide the application for condonation of delay first. 3.

In view of the above submissions, let the matter be sent back to the concerned Trial Court for deciding the application seeking condonation of delay, on the next date of hearing, as per law.
