By way of subject petition, petitioner seeks quashing of show cause notices dated 30.03.2016, 31.03.2016 and 17.02.2017. Learned counsel for the petitioner submits that pending the subject petition, the show cause notices have been adjudicated vide order dated 30.05.2023. He accordingly, seeks leave to withdraw the petition reserving the right of the petitioner to avail of further remedies in accordance with law inter alia impugning Orderin-Original dated 30.05.2023. 2.
We notice that proceedings have been adjourned sine die by order dated 25.09.2023 pursuant to a statement given on behalf of Commissioner of Customs that Transfer Petition has been filed in Supreme Court seeking transfer of subject petition as also the other batch of petitions. Learned counsel for petitioner seeks leave to withdraw the petition reserving the right of the petitioner to avail of such remedies as may be permissible in law inter alia impugning order dated 31.05.2023. 2.
