After making some submissions, Mr. Khurana, learned senior counsel for the petitioner seeks leave to withdraw the present petition with the liberty to approach the learned Trial Court to move an appropriate application seeking waiver of the condition no. 5, as imposed vide order dated 13.09.2022, passed by learned CMM, Patiala House Courts, New Delhi in case arising out of FIR no. 337/2016. 2.
It is also submitted by Mr. Khurana, learned senior counsel for the petitioner, that the matter is listed today itself before the learned Trial Court. 3.
