% 20.01.2025 CRL.M.A. 1514/2025 (for modification of the Order dated 04.12.2024) 1.

The Application under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.P.C.') (Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023) has been filed on behalf of the Petitioner for modification of the Order dated 04.12.2024 passed by this Court.

It is submitted that the Application bearing Crl.M.A. No. 36544/2024 under Section 482 of CrPC, 1973 was filed for withdrawal of the present Petition, in terms of the Settlement Agreement dated 29.05.2024. inadvertently recorded in Paragraph 6 of the Order that both the parties have no objection to quashing of the FIR. However, the prayer was only for withdrawal of the Application/Petition and neither party had made a Statement for quashing of FIR.

Submissions heard and the record perused.

In Paragraph 9, it has been recorded that in terms of the Settlement, the captioned Petition being Crl.M.C. No. 3369/2021 is dismissed as withdrawn. In Paragraph 6, though it has been recorded that both the parties have no objection to quashing of FIR but it refers to the terms of Settlement wherein the parties have agreed that they would be moving an Application, in terms of the Settlement for quashing of the FIR and other pending litigations between the parties.

It is hereby clarified that by virtue of Order dated 04.12.2024, it is only the captioned Petition, which has been permitted to be withdrawn and does not refer to any quashing of the FIR.

The Application is accordingly disposed of.
