W.P.(CRL) 2049/2024 By way of the present petition filed under Articles 226 and 227 of the Constitution of India read with section 482 of the Code of Criminal Procedure 1973, the petitioner seeks quashing of notice dated 10.06.2024 issued by the SHO, P.S.: Saket, New Delhi pursuant to DD No. 34A dated 05.06.2024 by which a complaint was received by the said police station from respondent No.5. seeks quashing of notice dated 08.06.2024 received from the office of ACP-1, Noida, Gautam Budh Nagar, Uttar Pradesh pursuant to a complaint bearing reference No. ACP-1(OB)-/2024 received from respondent No.5.

The petitioner further seeks stay of proceedings in both the aforesaid complaints pending consideration of this matter. 3.

At the outset, Mr. Aditya Wadhwa, learned counsel appearing for respondent No.5 submits, that the complainant/respondent No.5 has already addressed letter dated 01.07.2024 to the SHO, P.S.: Saket requesting that the complaint filed vide DD No. 34A against the petitioner be transferred for inquiry and further proceedings to the Noida Police.

A copy of letter dated 01.07.2024 has been handed-up by Mr. Wadhwa. The same is taken on record.

In view of the statement and the copy of communication being tendered by Mr. Wadhwa, Mr. Harsh Gupta, learned counsel appearing for the petitioner seeks leave to withdraw the present petition, with liberty to file any other appropriate challenge as may be maintainable before the court of competent jurisdiction, in accordance with law.

The petition is disposed-of as withdrawn, with liberty as prayed-for. 7.
