Through the present writ petition, the Petitioner prays for issuance of a writ in the nature of Certiorari to quash the promotion order dated 28.05.2025 (hereafter 'impugned promotion order'). 2.
The impugned promotion order was passed on the basis of proceedings of Departmental Promotion Committee ('DPC'), which was held on the basis of seniority list issued on 18.04.2023 and 19.04.2023. This seniority list has admittedly been quashed by the High Court of Delhi by judgment dated 25.03.2025. Special Leave Petitions filed against the judgment dated 25.03.2025, have been dismissed by the Hon'ble Supreme Court vide orders dated 01.08.2025 and 12.01.2026. The Review petition filed before the Hon'ble Supreme Court has also been dismissed on 24.02.2026. The correctness of these facts is not disputed. 4.
Keeping in view the aforesaid position, this Court is left with no choice but to quash the impugned promotion order, while directing the Respondents to hold a fresh DPC after preparation of a fresh seniority list for the rank of Assistant Commandant.

Notably, this Court, while deciding the Writ Petition, had already granted six months' time to the Union of India to prepare fresh seniority list, but no steps were taken. Accordingly, the Respondents are directed to complete the exercise of preparation of the fresh seniority list and thereafter, hold DPC, within a period of next three months from date.

The present petition is disposed of in the aforesaid terms. Pending application also stands disposed of.
