Present petition has been filed under Article 227 of the Constitution of India.

Petitioner happens to be defendant before the learned Trial Court and is aggrieved by order dated 14.08.2023 whereby he was not permitted to file his written statement on record. 3.

At the very outset, learned counsel for the petitioner states that in view of the subsequent development, he may be permitted to withdraw the present petition. It has been informed that the learned Trial Court has already decreed the suit on 30.03.2024. Such fact has not been disputed by the learned counsel for the respondent, who also appears through video conferencing.
