The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 482 of the Code of Criminal Procedure, 1973) has been filed by the petitioner praying for quashing of FIR No. 304/2025 registered at Police Station Shalimar Bagh for the offences punishable under Sections 75 and 79 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter "BNS").

The brief facts of the case are that the FIR was registered on the basis of a complaint made by respondent no. 2, alleging that soon after her marriage in 2013, when she started living in her matrimonial home owned by her in-laws, her father-in-law, who is the present petitioner, repeatedly The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
subjected her to sexual harassment and molestation by inappropriately touching her and teasing her whenever she was alone, and also abused and threatened to evict her and her husband if they objected. Further, out of distress, respondent no. 2 consumed about 20 PCM tablets, whereafter she was admitted to Jambh Multispecialty Hospital, Shalimar Bagh, and an MLC was prepared.

It is submitted that the petitioner and respondent no. 2 have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future.

Memorandum of Understanding/Settlement Deed dated 30.06.2025 is on record and has been annexed as "Annexure P-4". Qua this deed, the respondent no. 2 has agreed to withdraw the case arising out of FIR No. 304/2025 registered at Police Station Shalimar Bagh against the petitioner. 5.
It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 6.
Learned APP for the State, who appears on advance notice, accepts notice and submits that there is no opposition to the prayer made by the petitioner seeking quashing of the FIR in question in view of the settlement arrived at between the parties.

Heard learned counsel for the parties and perused the record. 8.
The petitioner is present before this Court and have been identified by her counsel and Investigating Officer, Police Station Shalimar Bagh. Respondent no. 2 is also present in the Court and has been identified by her counsel and the Investigating Officer.

volition and without any coercion or undue influence. It has further been stated that the entire dispute stands amicably resolved between the parties. She affirmed that the settlement has been arrived at for securing her future and, as a matter of prudence, the parties have decided to put a quietus to the present proceedings.

In view of the fact that the parties have amicably settled the matter, and further having regard to the circumstance that no useful purpose would be served by continuing with the present proceedings, which would rather cause hardship to respondent no. 2 in moving ahead with her life, this Court is conscious that ordinarily, it is not inclined to entertain petitions of this nature where the alleged offences are of a grave kind. However, since respondent no. 2 has voluntarily and of her own free will expressed her desire to put the matter behind her and move on with her life, this Court is persuaded to take this view.

It is, thus, in the interest of justice to quash the afore-mentioned FIR and the proceedings emanating therefrom.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh v. State of Punjab (2012) 10 SCC 303, FIR No. 304/2025 registered at Police Station Shalimar Bagh for the offences punishable under Sections 75 and 79 of the BNS, and consequent proceedings emanating therefrom, are quashed qua the present petitioner. 13.
The petition alongwith pending application(s), if any, stands disposed of.
