The present writ petition under Article 226 of the Constitution of India read with section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 ["BNSS"] has been filed by the Petitioner seeking the following reliefs:

"i.

Issue a writ or order in the nature of Mandamus directing to release the Petitioner on parole for a period of 4 weeks as the application vide F.18/07/2017/HG/334 dated 07.02.2025 has not been decided yet by the Respondent.

ii.

Pass any other order or further orders, which this Hon'ble Court deems fit and proper in the interest of justice;" 2.

At the outset, learned counsel for the Respondent/ State has handed over a print out of a rejection of the application of the Petitioner for grant of parole vide Order dated 04.07.2025. Upon a perusal of the same, learned counsel for the Petitioner seeks leave of this Court to withdraw the present petition and challenge the rejection Order dated 04.07.2025. 4.
