% 12.03.2018 After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and the applications filed therewith, the petitioner reserving the contentions vis-a-vis the prayer made in the application under Order XLI Rule 27 CPC to be agitated at the time of hearing on the appeal.

The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed for granted. It is made clear that the first appellate court will consider such contentions at the time of final hearing on the appeal uninfluenced by the observations in the impugned order dated 17.01.2018.
