Mr. Arun Khatri, Standing Counsel for the Narcotics Control Bureau,1 submits that the data extracted from the Applicant's mobile phone has now been analysed, revealing exchange of messages between the Applicant and other co-accused individuals, from whom a commercial quantity of the alleged contraband was recovered. In response, counsel for the Applicant submits that this data does not form part of the chargesheet and is being presented to the Applicant for the first time, after a considerable lapse of time.

Mr. Arun Khatri further states that the said data will be placed on record before the Trial Court within two weeks from today, as part of a supplementary chargesheet.

In light of the foregoing, counsel for the Applicant states that he would like to withdrawn the present application, and seeks liberty to apply before the Trial Court once the supplementary chargesheet is filed. 4.

Dismissed as withdrawn, with liberty as aforesaid. 5.

The NCB shall remain bound by the timeline specified by Mr. Arun Khatri.

As and when such bail application is filed by the Applicant, the same shall be examined by the Trial Court on its own merits. 7.

The Court has not commented on the merits of the case. All rights and contentions of the parties are left open.
