The petitioner has filed the present application, inter alia, praying for bail in connection with FIR No. 492/2019 under Sections 308/323/506/34 of the IPC, registered with PS Punjabi Bagh.

The said FIR was, initially, registered at the instance of the injured/complainant, who had alleged that he had been beaten up by the staff of the restaurant (Alqaza Restaurant 49, NWA, Club Road, Delhi). 5.
The status report has been filed, which indicates that the video footage of the incident at the restaurant was seized on 03.09.2019 and the petitioner
was seen beating up the complainant as well as his friends in the said footage. The complainant was admitted to Kalra Hospital and the MLC indicates that the injuries suffered by him are dangerous. 6.
It is also reported that one of the co-accused is still absconding and evading arrest. Given the description of the injury and considering that the CCTV footage shows the petitioner beating up the injured, this Court does not consider it apposite to allow the present petition at this stage. 7.
The petition is, accordingly, dismissed.
