By way of present petition, the petitioners are seeking quashing of FIR bearing No. 978.2015, registered at Police Station Begumpur, Delhi, for the commission of offences punishable under Sections 323/308/452/34 of Indian Penal Code, 1860 (hereafter 'IPC') and all consequential proceedings arising therefrom.

Issue notice. Mr. Rajkumar, the learned APP accepts notice on behalf of the State.

The present case arises out of a quarrel between neighbours over the issue of a parked vehicle obstructing the passage of a construction trolley in the street outside their houses in Jain Nagar, Karala, Delhi. This led to a physical altercation between the parties, during which both sides alleged assault and involvement of family members and associates. Subsequently, with the intervention of well-wishers and family members, the parties resolved their disputes amicably. Thereafter, vide order dated 30.09.2015, passed by the learned Additional & Sessions Judge-04, North West District, Rohini Courts, the petitioners herein had been granted bail on the ground that the parties had compromised the matter. 5.

The parties are present before this Court in person and have been identified by their counsels and Investigating Officer (IO) concerned. The complainant who is present in person before this Court states that he has no objection, if the FIR is quashed.

In the present case, it is evident that the parties did not take timely steps for quashing of the present FIR, and learned counsel for the petitioner could not offer any satisfactory explanation for this delay. However, considering that both parties had amicably settled their dispute as far back as 30.09.2015, it appears that neither the parties nor the Investigating Officer took appropriate steps to seek quashing or conclude the matter by filing a final report.

In such circumstances, allowing the proceedings to continue or filing a chargesheet would not serve the ends of justice and would be contrary to the spirit of the compromise already arrived at. 8.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion, this Court is of the opinion that no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. Accordingly, FIR bearing No. 978.2015, registered at Police Station Begumpur, Delhi, for the commission of offences punishable under Sections 323/308/452/34 of Indian Penal Code, 1860 (hereafter 'IPC') and all consequential proceedings emanating therefrom are quashed subject to petitioners depositing a sum of Rs. 10,000/- in the Advocates' Welfare Fund of Rohini Court and the compliance report of the same be filed with the Registry of this Court within a period of 10 days. 10.

In view of above, the present petition stands disposed of. 11.
