The Petitioner has approached this Court challenging an Order dated 24.03.2021 passed by Respondent No.2 impounding the passport of the Petitioner under Section 10(3)(e) of the Passports Act, 1967. 2.

A counter affidavit has been filed by the Respondents. Paragraph 7(b) of the counter affidavit reads as under:- "7. (b) It is further submitted that during the proceedings u/s 1 0(3)( e) carried out by the Respondent No.2, it was advised to the Petitioner to obtain NOC in terms of GSR 570(e) dated 25.08.1993 r/w section 6(2)(f) of the Passports Act, 1967. The objective behind advising applicant for obtaining NOC from the Hon'ble court was to avoid unnecessary submission of afresh application for issuance of passport that to be dealt separately under section 5(2) The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and 6(2)(f) r/w GSR 570(E) dated 25.08.1993 and till that time even passport was also not impounded. This is so because there was possibility that the applicant would furnish NOC by specifying period of validity already mentioned in his existing passport."

When this Court suggested to the learned Senior Counsel appearing for the Petitioner that the Petitioner can withdraw the instant writ petition and obtain an No Objection Certificate (NOC) from the concerned court and apply for a fresh passport, learned Senior Counsel for the Petitioner accepted the suggestion given by the Court and sought permission to withdraw the instant writ petition with liberty to apply for fresh passport after obtaining NOC from the concerned Court.

The application for grant of passport be processed and passport can be given to the Petitioner within a period of three weeks from giving the NOC. 5.

With these observations, the writ petition is disposed of as withdrawn along with pending application(s), if any.

Liberty is granted to the Petitioner to approach this Court in case need arises in future.
