Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been filed on behalf of the Petitioners, for quashing of FIR No. 0337/2019 under Sections 498A/34 IPC, registered at PS: Mansarover Park, Delhi and all consequential proceedings emanating therefrom, in terms of Settlement Deed dated 21.07.2025. 2.

Brief facts of the case are that the marriage between Petitioner No.1/husband and the daughter of Respondent No.2 was solemnized on 14.04.2012, according to the Hindu rites and ceremonies. A female child was born out of the said wedlock, who shall be in custody of Resopndent No.2. Respondent No.2 were residing separately since 01.06.2014. 5.
It is further submitted that on 25.09.2019, on Complaint of daughter of Respondent No.2, present FIR No. 0337/2019 under Sections 498A/34 IPC was registered at PS: Mansarover Park, Delhi. 6.
It is submitted that present FIR was a consequence of the matrimonial disputes between Petitioner No.1/husband and daughter of Respondent No.2. 7.
It is stated that with the intervention of family members, relatives and well wishers, the Petitioners and Respondent No. 2 (mother of Complainant/ Petitioner's wife) have amicably settled all the disputes and differences between them vide Settlement Deed dated 15.05.2025. Settlement is without prejudice to the rights of the child.

Respondent No.2, who is mother of the Complainant / Petitioner's wife, submit that during the lifetime of Complainant Ms. Pratima Kumari, present FIR No.0337/2019 was registered, but thereafter, she expired on 14.09.2022 due to cancer. Death Certificate is attached with the Petition. 9.
It is also stated that during lifetime of the Complainant, on 12.03.2020, the marriage between Petitioner No.1/husband and daughter of Respondent No.2 was dissolved by mutual consent, as per the Hindu law. 10.
It is stated that Petitioner No.1/husband has already paid Rs.1,00,000/- to Respondent No.2/mother of Complainant, which is acknowledged by her. The balance settled amount of Rs.40,000/- has also been paid today in the Court by way of DD No.726963 dated 08.10.2025 drawn on SBI in favour of Respondent No.2, which is accepted by her. 11.
The parties are present in the Court and have been identified by the IO. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Learned Counsel for Petitioners submits that the parties have no grievance against each other. Since Respondent No. 2 has already made a statement before the Court that she does not want to pursue the proceedings in FIR, the present Petition be allowed and FIR No.0337/2019 be quashed. 13.
In view of Settlement Deed dated 15.05.2025, present Petition has been filed.

Respondent No.2 is present and submits that she has no grievance against the Petitioners and also no objection to the quashing of FIR. 15.
In view of the fact that the FIR in question was premised upon a matrimonial dispute between Petitioner No.1/husband and daughter of Respondent No.2, which has been amicably resolved in terms of Settlement dated 15.05.2025. Considering the fact that Respondent No.2 has given no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR. 16.
Consequently, FIR No.0337/2019 under Sections 498A/34 IPC, registered at PS: Mansarover Park, Delhi and all consequential proceedings emanating therefrom are quashed.
