Application under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 ('BNSS') has been filed on behalf of the Petitioner for early hearing of the Petition on the ground that the matter has been amicably settled between the parties and the parties are present today in the Court. 4.
For the reasons stated in the Application, the same is allowed and the matter is taken up for hearing today with the consent of the parties. CRL.M.C. 4304/2025 5.

Brief facts of the case are that the marriage between Petitioner No.1/husband and Respondent No.2/wife was solemnized on 26.07.2021, according to the Muslim rites and ceremonies. No child was born out of the said wedlock. Due to temperamental issues, Petitioner No.1/husband and Respondent No. 2/wife are residing separately since 20.12.2022. 7.
It is further submitted that on 05.01.2023, on the basis of complaint made by Respondent No.2, FIR No.0007/2023 under Sections 376/377/506 IPC, registered at PS: Mohan Garden, Delhi was registered. 8.
It is submitted that the FIR was a consequence of the matrimonial disputes between Petitioner No.1/husband and Respondent No. 2/wife. It is stated that the Petitioners and the Respondent No.2 have amicably settled all the disputes and differences between them vide Compromise Deed dated 26.05.2025.

The parties are present before this Court in-person today and have been identified by their learned Counsel and concerned Investigating Officer.

Respondent No.2 affirms that she has been duly granted divorce by way of triple talaq in accordance with law and that she has been given full amount of settlement, i.e. Rs.2,75,000/-. One car of make Maruti Suzuki has also been returned by the Petitioners to Respondent No.2 and all the disputes have been amicably settled between them, in terms of Compromise Deed dated 26.05.2025, wherein it is also submitted that the parties shall withdraw all the proceedings pending against each-other. 11.
In view of Compromise Deed dated 26.05.2025, the present Petition has been filed.

The parties have endorsed the amicable Settlement and accepted the terms thereof voluntarily and have undertaken to remain bound by the terms of the Compromise Deed. The parties have submitted that all the disputes have been amicably settled vide Compromise Deed dated 26.05.2025 and thus, no fruitful purpose will be served in continuing with the FIR. The present Petition has been signed by the Petitioners and is supported by their Affidavits and they submit that the said Settlement has been arrived at between the parties, without any pressure and coercion. 13.
The Respondent No. 2 states that she has received all amounts due to her and has no objection if the FIR is quashed. 14.
In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is a family matter, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. 15.
Moreover, there is no legal impediment in quashing the aforesaid FIR in question.

Consequently, FIR No.0007/2023 under Sections 376/377/506 IPC, registered at PS: Mohan Garden, Delhi and all consequential proceedings emanating therefrom are quashed.

The Petition along with pending Application, if any, is disposed of. 18.
