Petition under Article 226 of the Constitution of India read with Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking grant of Parole for four weeks in light of medical treatment of his wife and himself.

However, Application filed before the Jail Authorities has been dismissed on 04.07.2025, during the pendency of present Petition, on the ground that Petitioner had not undergone one year of imprisonment as a convict.

However, learned counsel for the Petitioner submits that since more than one year of imprisonment as a convict has passed, he may be permitted to withdraw the present Writ Petition with liberty to apply afresh with the Jail Authorities for seeking parole/furlough. 4.
It is directed that the Application so filed with the Jail Authorities shall decide the same within a month of its filing.
