The petitioner in the instant petition prays for the following relief:- "a. Direct the respondent to consider and dispose of the regularization applications I representations in a Judicious and time bound manner with a humanitarian approach, in the interest of justice and fair play; b. Direct the respondent to regularize the portion of demise premise within the compoundable limits and demolishing the portion of the demised premise beyond the compoundable limits of the building byelaws; and c. Restraining the respondent- department from dispossessing the petitioners from the subject property in pursuance to Notice dated 18.06.2024 under section 349 DMC Act, till the disposal of the present petition."

The facts of the case clearly indicate that the application which is sought to be disposed of by the respondent-MCD itself was filed on 08.07.2024.

The Court is, therefore, unable to accede to such an unreasonable prayer, where the petitioner appears to have simultaneously filed the petition and has made the application without granting respondent-MCD sufficient time to deal with such request.

The petition, therefore, seems to be premature and accordingly, stands dismissed, at this stage, along with the pending applications.
