Petition under Section 482 Cr.P.C has been filed for challenging the Summoning Order dated 15.01.2019 on the ground that the Petitioners are the independent Executive Directors and are not liable for the offence under Section 138 N.I.Act.

Learned counsel on behalf of the Respondent Complainant has pointed out that Application for the same relief was filed on behalf of the Petitioners which has been dismissed vide Order dated 30.07.2019 by the learned M.M which fact has not been mentioned in the Petition which has been filed on 30.11.2021.

After some submissions, learned counsel for the Petitioners seeks permission to withdraw the present Petition with liberty to file the appropriate Application in accordance with law.

In view of the submissions made, Petition is permitted to be withdrawn.
