This hearing has been done through hybrid mode. CCP(O) 42/2024 in ARB.P. 1027/2023 2.

This is a contempt petition filed under Section 11 and 12 of the Contempt of Courts Act, 1971. The allegation of the Petitioner was that the Respondents/Contemnors were not complying with the order passed by this Court on 10th April, 2024 in ARB.P. No. 1027/2023. It is stated that the said order incorporated the terms and conditions of the Settlement Agreement dated 2nd April, 2024 (hereinafter, 'settlement agreement'). 3.

Today, ld. Counsel for the Petitioner submits that the terms of the settlement agreement have been complied with by the Respondent. Therefore, the present contempt petition would no longer be pressed by him. 4.

Ld. Counsel for the Petitioner further submits that the complaint filed under Section 138 of the Negotiable Instruments Act, 1881 against the Respondent No.1 and its directors, being Complaint Case No. 4568/2021 titled Samaksh Goyal v. pending before the Additional Civil Judge, (Junior Division) Court at Dehradun. The same was to be withdrawn by the Petitioner, however, the Petitioner was unable to do so as the Dehradun Court was on strike on the previous occasion.

Ld. Counsel for the Petitioner assures and undertakes to the Court that the same would be withdrawn on the next date. subject to the Court being functional.

Accordingly, CCP(O) 42/2024 is disposed of.
