The present petition is filed seeking directions for registration of FIR for offences under Sections 323/ 380/ 452/ 441/ 341/ 120B/ 504 / 506 of the Indian Penal Code, 1860 ('1860') on the written complaint dated 26.06.2024 bearing DD No.65A, submitted by the petitioner at Police Station Greater Kailash.

The said complaint was made alleging that when the petitioner along with his staff had gone to check and repair the water tank of the petitioner's basement and water tank of the stilt area, the accused persons who are the petitioner's neighbours and their employees wrongfully restrained them. It is also alleged that the gold chain of the petitioner was snatched and he was beaten by the accused persons.

It is pertinent to note that the petitioner has not availed the appropriate remedy under Section 156 (3) of the Code of Criminal Procedure, 1973.

The petitioner and his neighbours along with their respective employees are involved in multiple litigations and the present dispute also arose out of the prior acrimony. 5.
This Court, in common order dated 16.07.2024, passed in W.P.(CRL) 2067/2024 and W.P.(CRL) 2069/2024 (filed in relation to other disputes between the neighbours), had noted the submission of Mr. Sanjay Lao, Standing Counsel for the State, that he would personally make an endeavour to mediate the dispute and get the matter amicably resolved. 6.
It is stated that the matter is amicably settled with the intervention of Mr. Sanjay Lao, the learned Standing Counsel, on their own free will, without any threat, force, coercion or misrepresentation. It is also pointed out that the neighbours have also amicably entered into a settlement dated 05.08.2024 wherein it has been agreed that appropriate steps will be taken for quashing of the multiple FIRs registered by them against each other.

In terms of the settlement dated 05.08.2024, the petitioner undertook to withdraw or seek quashing of the proceedings initiated by him as well. The present complaint has also been listed as one of the complaints given by the petitioner. 8.
The petitioner is present before this Court in person and he is duly identified by his counsel.

The learned counsel for the petitioner, on instructions, submits that the petitioner does not wish to pursue the complaint and he wants to withdraw the present matter in view of the settlement.
