The petitioner has filed this petition under Section 9 of the Arbitration and Conciliation Act, 1996 ["the Act"], for interim measures of protection in anticipation of arbitral proceedings under a lease deed dated 18.09.2017, read with an addendum dated 01.01.2019. 2.

The learned counsel for the parties are ad idem that the disputes have been settled by way of a settlement agreement dated 09.06.2024. A copy of the settlement agreement has been handed over in Court by Mr. Deepak Vohra, learned counsel for the petitioner, and is taken on record. 3.

According to Mr. Vohra, the settlement agreement has been fully implemented as far as respondents No. 2, 3 and 4 are concerned. amounts remain to be paid.

While this aspect is disputed by Mr. Piyush Wadhwa, learned counsel for respondent No.1, it is unnecessary to adjudicate this finally as Mr. Vohra does not seek interim measures of protection in this petition. He only wishes to reserve the petitioner's right to press the petition filed under Section 11 of the Act [Arb. P. 422/2023], which is pending in this Court.

In view of the fact that no further interim measures for protection are sought, this petition is disposed of. It is made clear that this order is without prejudice to the rights and contentions of the parties in Arb. P. No. 422/2023 or in any proceedings that may commence thereafter.
