This is an application filed by the appellant seeking condonation of delay in filing the appeal.

According to the appellant, there is a delay of 124 days in filing the appeal.

Mr Ayyub Ahmad, learned counsel, who appears on behalf of the respondents, says that he would have no objection if the delay is condoned. 3.1 It is ordered accordingly.

This appeal is directed against the judgment and order dated 17.03.2023 passed by the learned District Judge (Commercial) (Digital)-07, South-East, Saket Courts, New Delhi.

Upon notice being issued in the appeal, Mr Ayyub Ahmad, learned counsel, entered appearance on behalf of the respondents. 6.1 To be noted, the respondents are present in Court. 7.

After some arguments, counsel for the parties agreed that the appeal could be disposed of in the following terms.

(i) Ms Sonu Bhatnagar, Advocate, [Mobile No. 9810134678] is appointed as Arbitrator to adjudicate the disputes obtaining between the parties.

(ii) The respondents will file their statement of defence within eight (08) weeks of the case papers being furnished by counsel for the appellant, which would include the statement of claim and documents filed by the appellant. 8.

Ms Bhatnagar will determine whether any fee is to be charged in the matter having regard to the fact that the respondents do not seem to have the necessary wherewithal.
