W.P.(CRL) 440/2018 Petitioner is seeking quashing of the present FIR i.e. the FIR No.0398/2016 registered under Sections 498A/406/34 of the IPC as also under Section 4 of the Dowry Prohibition Act at the behest of the petitioner at police station New Usman Pur. Respondent no.2 is the ex-husband of the petitioner. Parties had been married. Since their marriage was not cordial they had entered into a decree of divorce by mutual consent on 24.8.2017. In terms of the settlement arrived at inter se the parties, the respondent no.2 has agreed to pay a sum of ₹ 2,85,000/- to the petitioner of which ₹1,85,000/- already stand paid

and balance sum of ₹1,00,000/- is being paid by respondent no.1 today in Court to the petitioner which amount has been accepted by her. Petitioner accordingly prays that the present FIR proceedings be quashed.

To secure ends of justice it would be imperative if the prayer made in the present petition is granted. Accordingly, the FIR No.0398/2016 registered under Sections 498A/406/34 of the IPC as also under Section 4 of the Dowry Prohibition Act at police station New Usman Pur and all the proceedings emanating therefrom stands quashed.

Petition disposed of in the above terms.
