The present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks grant of pre-arrest bail in the proceedings emanating from FIR No. 154/2024, registered at P.S. Sunlight Colony under Sections 380/34 of the Indian Penal Code, 1860. The allegation against the Applicant is that he assisted the co-accused, Saumya Rajput and Ravi Kumar, in the preparation of forged documents and facilitated the encashment of stolen cheques.

Considering the aforesaid allegations, this Court, by order dated 12th July, 2024, granted interim pre-arrest bail, subject to certain conditions, including the requirement to join the investigation. 3.

In compliance with the aforenoted directions, the Applicant has joined the investigation. In the meantime, it appears that a settlement has been reached between the Applicant and the Complainant. Mr. Rakesh Srivastava, counsel for the Complainant, on instructions, confirms the factum of the settlement, and states that the Applicant has agreed to pay an amount of INR 2.25 lakh to the Complainant. It is further submitted that the parties shall now be moving an application for quashing of the subject FIR on the basis of the settlement.

Be that as it may, it is noted that consequent to the Court's directions, the Applicant has joined and cooperated in the investigation. It is further brought to the notice of this Court that the other co-accused, Saumya Rajput and Ravi Kumar, have already been granted pre-arrest bail by the Sessions Court.

In light of the foregoing facts and circumstances, the Court is inclined to allow the Applicant's request, subject to the Applicant's continued cooperation with the investigation as and when required by the Investigating Officer.

Accordingly, the application is allowed. The Applicant, in the event of arrest, is directed to be released on bail on furnishing a bail bond for a sum of ₹20,000/- with one surety of the like amount subject to the satisfaction of the concerned SHO, on the following conditions: a.

The Applicant shall join and cooperate with the investigation as and when directed by the IO;

The Applicant shall not leave the boundaries of the country without informing the IO/ SHO concerned;

c.

The Applicant shall not contact the witnesses or tamper with the evidence in any manner;

d.

The Applicant shall give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times; 7.

In the event of there being any FIR/DD entry / complaint lodged against the Applicant, it would be open to the State to seek redressal by filing an application seeking cancellation of bail. 8.

It is clarified that any observations made in the present order are for the purpose of deciding the present bail application and should not influence the outcome of the trial and also not be taken as an expression of opinion on the merits of the case.
