By way of present petition filed under Section 439(2) read with Section 482 Cr.P.C., the petitioner/complainant seeks cancellation of anticipatory bail granted to respondent Nos.2 to 4 in FIR No. 256/2023 registered under Sections 498A/406/354/506/34 IPC at P.S. Vikas Puri. 2.
Learned counsel for the petitioner submits that immediately after passing of the anticipatory bail order, the complainant received sweets which is a further act of cruelty by respondent Nos.2 to 4. He further submits that respondent Nos.2 to 4 have also not taken any steps for reconciliation. The next contention raised is that respondent Nos.2 to 4 have in fact approached the uncle of the petitioner for reconciliation. 3.
None of the above raised contentions merit entertaining the present petition. was delivered by some stranger. The other two contentions are in fact contrary to each other inasmuch as it is the grievance of the petitioner that no conciliation effort have been made by respondent Nos. 2 to 4 and at the same time, it has been contended that respondent Nos.2 to 4 have approached uncle of the petitioner. None of the contentions raised fall within the parameters of cancellation of bail and are accordingly, rejected. The petition is dismissed alongwith the pending applications. 4.
Needless to state that nothing stated in the order passed by the trial court shall amount to an expression on the merits of the case and shall not have a bearing on the trial.
