Notice was issued in W.P.(C) 13118/2023 by an order dated 06.10.2023, and it was recorded as follows:- "1.

Issue notice. Mr. Kushagra Kumar, learned counsel, accepts notice on behalf of the respondents.

I am informed that W.P.(C) 13809/2018, in which the challenge to the very same commercial circular [Clause 11 of Circular No. 20/2017] has been agitated, is pending before this Court.

Mr. Jitender Mehta, learned counsel for the petitioner, states that the said writ petition was filed pursuant to the liberty granted by the Supreme Court vide order dated 30.10.2018 in W.P.(C) 557/2017. By the aforesaid order, the Supreme Court granted status quo qua the license of the petitioner therein for a period of two weeks. That order has been continued by virtue of interim order dated 20.12.2018 read with orders dated 08.03.2019 and 15.03.2019 in W.P.(C) 13809/2018.

In view of the above, in the present case also, the parties will maintain status quo with regard to the petitioner's license until the next date of hearing before this Court.

Counter affidavit may be filed within four weeks. Rejoinder thereto, if any, may be filed within two weeks thereafter. 6.

List this writ petition, alongwith W.P.(C) 13809/2018, on 31.01.2024."

Similarly, in W.P.(C) 16713/2023, notice was issued by order dated 22.12.2023.

It is now contended that the challenge in W.P.(C) 13809/2018 is predicated on different grounds.

Mr. Jitender Mehta, learned counsel for the petitioner, seeks permission to withdraw these writ petitions with liberty to approach the Court of appropriate jurisdiction, as the petitioners' cause of action is in respect of catering stalls operated outside Delhi. 5.

The petitions are dismissed as withdrawn, with liberty as aforesaid. 6.

The petitioners have been protected by the aforesaid order of status quo during the pendency of the petition in this Court. The said order will continue to operate for a period of four weeks from today, and the parties will thereafter be governed by any orders passed in the proposed petitions filed by the petitioners.
