A Special Leave Petition has been filed on behalf of the Appellant challenging the Judgment dated 26.09.2018 passed by learned CMM, New Delhi, thereby acquitting the Respondent in Complaint Case under Section 132 and 135(1)(a) of the Customs Act, 1962.

It is submitted in the Petition that the impugned Order is contrary to the evidence on record. The learned Trial Court has not appreciated that the Complaint was filed by a Public servant in discharge of the official duty without any enmity. The Application of the Respondent for pleading guilty was also not decided.

Considering the submissions made in the Leave Petition, the same is allowed and is disposed of accordingly.
