Application under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 (CPC) has been filed on behalf of the Appellant for disposing of the Appeal in terms of irrevocable Settlement dated 04.11.2023 between the parties and release of Rs.13,00,000-/ along with interest accrued from 05.11.2023 till realization of the aforesaid amount to the Respondent.

Regular First Appeal under Section 96 read with Order XLI CPC has been filed on behalf of the Appellant against the Order dated 04.06.2022 of the learned Civil Judge.

As per the Order dated 05.12.2022, a sum of Rs.13 lakhs was deposited by the Appellant with the Registrar General through demand draft dated 13.01.2023. The parties have thereafter, entered into an irrevocable Settlement dated 04.11.2023 and have undertaken to abide by the terms and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. condition. It was, therefore, submitted that the RFA be disposed of in terms of the Settlement.

In terms of Settlement dated 04.11.2023, it has been agreed that a sum of Rs.13 lakhs be released to the Respondent while any remaining amount be released to Mr. Manish Aggarwal.

Both the parties endorse the Settlement, but the dispute has been raised in regard to payment of the interest amount which has accrued after the date of Settlement, i.e., 04.11.2023.

It is quite evident that the money which has been deposited in this Court, was to be released forthwith, but for whatever confusion between the parties, the amount has still not been released. 7.
In equity, it is directed that the sum of Rs.13 lakhs with the corresponding interest from 04.11.2023, till the date of release that may have accumulated/accrued, be released to the Respondent in terms of the Settlement dated 04.11.2023.

Both the Counsel submit that the Appeal be disposed of in terms of Settlement dated 04.11.2023.

The Applications are accordingly disposed of. Consequently, the Regular First Appeal also stands disposed of. NEENA BANSAL KRISHNA, J.
