This application has been filed on behalf of the plaintiff under Order XXIII Rule 1(3) of the Code of Civil Procedure, 1908 seeking permission to withdraw the present suit.

It is stated in the application that the parties have arrived at an out of Court settlement, the terms of which are confidential. 3.

Without prejudice to the rights and contentions of the parties, the plaintiff is permitted to withdraw the present suit. 5.

Accordingly, the suit is dismissed as withdrawn. 6.

In view of the fact that the matter has been settled at the initial stage, the Registry is directed to issue a certificate of refund of 50% of the Court Fees in favour of the plaintiff, in terms of Section 16A of the Court Fees Act, 1870, as applicable to Delhi.

Registry is directed to return all the products relating to the case filed on behalf of the plaintiff.
