The petition is for setting aside notice dated 02.12.2021 issued by respondent no. 1-authority whereby, a dispute between the petitioner and respondent no. 2 has been referred for arbitration under Section 18(3) of the Micro Small and Medium Enterprises Development Act, 2006. Further, a prayer for setting aside notice dated 07.12.2021 issued by the Delhi International Arbitration Centre directing the petitioner to participate in the arbitration proceedings has been made.

This Court, vide order dated 05.04.2022 had stayed the said arbitration proceedings. It appears that owing to the interim order, the parties have instituted a civil suit.

The Court thus finds that as of now the cause raised herein has been rendered infructuous. The parties, thus, are granted liberty to raise all issues in the pending case(s) between them.
