This is an application under Section 483 BNSS read with Section 439 Cr.P.C for grant of regular bail filed by the petitioner-Ashish Kumar. 2.

Learned counsel for the petitioner submits that nothing has been recovered at his instance. He states that the petitioner is in custody since 18.02.2025 and the nature of injury has been opined as simple and the injured was discharged on the same day.

Status report is filed which is taken on record. 4.

The application has been opposed by learned APP submitting that the petitioner filed an application for interim bail before the trial court after filing of the present application and without disclosing the fact that his regular bail application was pending before this Court. that offence is of serious nature inasmuch as the petitioner attacked a police official on duty and caused him injuries with stone. 5.

As per allegations, an information was received vide DD No. 15A that DJ is being played near Pillar No. 118, Pratap Nagar, Delhi. Upon receipt of such information, ASI Ravinder along with other staff went at the spot. It was a marriage function. ASI Ravinder asked the person playing the DJ to stop the same. The applicant intervened and refused to get the DJ stopped claiming that it was his marriage function. The applicant then picked up a stone and hit the same on the head of ASI Ravinder, due to which, he became unconscious and had to be rushed to the hospital where he got three stitches on his head.

Admittedly, the injured has since been discharged from the hospital and the nature of injuries is opined to be simple in nature. The petitioner is stated to be in custody since 18.02.2025. The investigation is stated to be complete and charge sheet has already been filed before the trial court. 7.

Hence keeping in view the entire facts and circumstances, the petitioner is admitted to bail subject to his furnishing a personal bond for a sum of Rs.20,000/- with a surety in the like amount to the satisfaction of the trial court with direction that petitioner shall cooperate during the trial. 8.
