Though the present petition seeking quashing of FIR No. 878/2020 registered under Sections 377/451/323/506 IPC at P.S. Najafgarh has been premised on ground of settlement, however, counsel for respondent No.2 states that present FIR was not covered under the settlement arrived at between the parties.

In view of the above, learned counsel for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to file afresh petition on merits.

Leave and liberty, as prayed for, are granted and the petition is dismissed as withdrawn alongwith miscellaneous application.
