Petition under Section 482 of the Code of Criminal Procedure, 1973 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.'), has been filed on behalf of the Petitioners, for quashing of FIR No. 0158/2020 dated 12.03.2020 under Section 498-A/406/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Karawal Nagar and all the consequential proceedings emanating therefrom, in view of the Compromise Deed dated 23.02.2024.

On advance Notice, learned APP has appeared and accepts Notice on behalf of the State.

Brief facts of the case are that the marriage was solemnized between the Petitioner No.1/husband and the Respondent No. 2/wife on 15.02.2015, according to the Muslim rites and ceremonies and two children namely master Vir and baby Arushi, were born out of the said wedlock. Thereafter, owing to temperamental differences, they started living separately from each other.

On the Complaint of the Respondent No.2, FIR No. 0158/2020 dated 12.03.2020 under Section 498-A/406/34 IPC, got registered at Police Station Karawal Nagar.

It is submitted that the FIR was a consequence of the matrimonial disputes between the Complainant and the Petitioner No.1. It is stated that the Petitioner No. 1 and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement dated 23.02.2024 before the Delhi Mediation Centre, Karkardooma Courts, Delhi. In the Settlement, it was inter alia settled between the parties that they shall continue to live together as husband and wife. It is also settled between the parties that the husband shall maintain the wife and minor children including food, medical expenses, clothing and other day to day financial requirements etc. It is further agreed between them that the husband shall pay an amount of Rs.15,000/- per month to the wife towards household expenses by 10th day of every month commencing from March, 2024. It is also settled between the parties that the Respondent No. 2 shall withdraw the present DV Act Complaint, from the Court concerned.

Today, the Respondent No. 2/wife, who is present in the Court, states The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

that she has no objection if the said FIR is quashed. 10.

The Statement of the parties have already been recorded before the learned Joint Registrar. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering that the parties have settled the matter, the FIR No. 0158/2020 dated 12.03.2020 under Section 498-A/406/34 IPC, registered at Police Station Karawal Nagar and all the consequential proceedings emanating therefrom, are quashed.

The Petition is disposed of accordingly.
