O R D E R

% 21.02.2025 1.

The petitioner has filed the present petition, inter alia, praying as under:

"(i) Issue Writ of Mandamus and/or any other appropriate suitable writ(s), order(s) and/or direction(s) to the respondents to pay the compensation amount in lieu of the acquired land bearing Khasra No. 421Min.(03-18) situated in the revenue estate of village Jasola, New Delhi, to the extent of his respective share, acquired vide Award No. 247/1986-87 of Village Jasola, New Delhi in accordance with law to the petitioner."

The petitioner claims that he and his predecessor-in-interest are the owner/ have interest in the land comprising in Khasra No. 421 Min. (03-18) situated in the revenue estate of village Jasola, New Delhi (hereafter the subject land).

subject land for the purposes of construction of Road No. 12-A, connecting Mathura Road to existing Barrage-cum-bridge over river Yamuna near Okhla, was issued on 12.05.1986.

The aforesaid Notification was followed by a declaration dated 13.05.1986 under Sections 6 and 17 of the LA Act and thereafter, an award being Award No. 247/1986-87 was published on 06.10.1986. 5.

The petitioner states that the possession of the subject land was taken over on 24.10.1986 but no compensation was paid. 6.

The petitioner claims that his predecessor-in-interest had made several requests and personal visits to the Land Acquisition Collector (LAC) for release of compensation however, the same was not released. The petitioner, on 18.06.2022, had issued a legal notice to the LAC, demanding the payment of compensation in lieu of the acquired land. A reminder to the aforesaid notice was filed on 24.07.2023, however, no payments have been released to the petitioner till date.

The learned counsel appearing for the Land Acquisition Collector (LAC) states that the compensation due to the petitioner will be paid in accordance with law subject to the necessary verification within a period of three months. Respondent no. 1 is bound down to the said statement. 8.

The petition is allowed in the aforesaid terms.
