A Petition under Section 482 of the Code of Criminal Procedure, 1973 and Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of the FIR No.1316/2015 registered under Sections 354/354A/354D/506/509 IPC at Police Station Mukherjee Nagar, Delhi.

The brief facts as narrated in the FIR are that on 23.09.2015 the Complainant/Respondent No.2 gave a Complaint in Police Station Mukherjee Nagar against one Manish Sethi stating that she was running a boutique and the Petitioner who was in the business of providing material contacted her and on her approving the samples, the Petitioner started supplying her the material for boutique. frequently and she noticed that the Petitioner started talking to her forcefully. On this she stopped taking material from the Petitioner. On the day of Janmashtami, the Petitioner came to her boutique and offered her friendship, which she refused. The Petitioner started calling her from different numbers and said that she should not tell this to any of the family members. On 23.09.2015 when she had gone to market to purchase things, the Petitioner started following her and made obscene gestures. She called her brother who came and had taken the Petitioner to the Police Station. On the Complaint of the Complainant/Respondent, the Police registered an FIR No.1316/2015 under Sections 354/354A/354D/506/509 IPC. 3.
It is submitted that both the Petitioner and respondent No. 2 vide MOU dated 03.06.2025 have already sorted out their all differences with the intervention of their respective persons of the vicinity and they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed.

The complainant has appeared through V.C. and submits that she has now got married and settled in Kolkata and has a small child. She further states that since the date of registration of FIR, there have been no unwarranted event and she has settled in the matrimonial life. She has no objection if the FIR is quashed against the petitioner on account of the settlement already arrived at between the parties. 5.
The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. The Petitioner submits that he is voluntarily paying Rs.50,000/- to the Respondent No.2/Complainant which is transferred today electronically in the account of the Complainant.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 1316/2015 registered at Police Station Mukherjee Nagar, for offences punishable under Sections 354/354A/354D/506/509 of the Indian Penal Code, 1860 with all the subsequent proceedings and the charge sheet is hereby quashed qua the Petitioner.
