O R D E R

The mediation settlement agreement dated 17.01.2018 has been received from Delhi High Court Mediation and Conciliation Centre. 2.

Impugned Award dated 21.01.2013 passed by learned Presiding Officer Labour Court has been challenged by the Management in W.P.

(C) No.1879/2013 and by the workmen in W.P.(C) No.1883/2015.

It is submitted by learned counsel for both the parties that vide Settlement Agreement dated 17.01.2018, the parties have amicably resolved and settled all their disputes. The management has agreed to pay a lump sum amount of Rs. 1,25,000/- to the workman in full and final settlement for all his claims. Parties shall remain bound by the terms & conditions of Settlement Agreement.

In view of the settlement, W.P.(C) 1879/2013 along with CM No. 3737/2018 & W.P.(C) 1883/2015 are disposed of accordingly. 5.

At this stage, it is pointed out by the learned counsel for both the parties that in terms of the order of this Court dated 21.03.2013 in W.P.(C) 1879/2013, the management has deposited a sum of Rs.1,00,000/- with the Registry of this Court. In view of the settlement, it is directed that the principal amount of Rs.1,00,000/- be released to the workman with interest accrued thereon to the extent of Rs.1,25,000/- in all. In case of deficiency, the balance shall be paid by the management to the workman within two weeks. If the accrued interest on principal amount exceeds Rs.25,000/-, the excess amount shall be refunded to the petitioner.

In the circumstances, when both the petitions are disposed of, the next date of hearing i.e. 13.02.2018 in W.P. No.1883/2015 is cancelled. VINOD GOEL, J.
