This hearing has been done through hybrid mode. 2.

This is a petition filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter, 'the Act'), for appointment of sole Arbitrator. It is stated that the Petitioner and the Respondents entered into an agreement for taking a vehicle on lease. The Lease Agreement bearing no. SME 300264 dated 27th of February, 2019 as well as Agreement for Fleet Management Services bearing No. 600038 was signed and executed between both parties.

The Respondent No.1 is stated to have taken the lease and fleet management services of Petitioner in respect of vehicle/car, utilized the said vehicle with all types, however, the said Respondent failed to make the payment of the Monthly Lease Rental from beginning leading to an outstanding amount of more than 11 lakhs. It is also stated that the Petitioner requested the Respondent through different mediums. However, there was no response.

In view of the above, the Petitioner invoked the Arbitration clause and filed the present petition under Section 11 (6) of the Act. 5.

Ld. Counsel for the Petitioner, today, wishes to withdraw the present petition as repeated attempts to serve the Respondents have been in vain. According to counsel for the Petitioner, the Respondent company is not traceable.
