% 11.03.2016 Learned counsel for the respondent submits that in view of the new provision of Section 9(3) of the Arbitration and Conciliation Act, 1996, as the Arbitral Tribunal is in place, this Court shall not entertain the application as the petitioner has a remedy under Section 17 of the Act.

On this submission, Mr.Bhagat states that he will withdraw the petition and file appropriate application before the Arbitral Tribunal. The present petition is dismissed as withdrawn. Dasti.
