This writ petition has been preferred on behalf of the Petitioner under Article 226 of the Constitution of India laying a challenge to the transfer order dated 31.05.2024 whereby he has been transferred to Mumbai and the relieving order dated 13.06.2024 inter alia on several grounds, one of them being that there are contemplated disciplinary proceedings against him and he apprehends that he may not be able to defend them, if he is posted to Mumbai.

After canvassing some arguments, learned counsel appearing on behalf of the Petitioner, on instructions, seeks to withdraw the present petition. defend them effectively from Mumbai. It is further prayed that Respondent be directed not to treat the absence period from the date of issue of transfer order till the date of joining at Mumbai since Petitioner was availing his legal remedies against the transfer order.

Mr. Rajiv Kapur, learned counsel appearing on behalf of Respondent, on instructions, candidly states, that the absence period of the Petitioner from the date of issue of the transfer order and till the joining at Mumbai will be adjusted against his authorized leaves and will not be treated as unauthorized absence.

Writ petition is accordingly disposed of, granting liberty to the Petitioner to make a representation in case disciplinary proceedings are commenced against him at Delhi, in accordance with law. Pending application also stands disposed of.
