The petitioner was an employee of Lok Sabha Secretariat, and retired on 30.06.2021 from the post of Printing Assistant, Proof Reading Section, Printing and Publishing Service, Lok Sabha Secretariat. He has filed this petition under Article 226 of the Constitution, for a direction upon the respondent to provide him with a notional annual increment, which would have become due to him on 01.07.2021. 2.
In accordance with the judgment of the Supreme Court in KPTCL v. C.P. Mundinamani, [(2023) 14 SCC 411], and the orders dated 06.09.2024 and 20.02.2025 in Union of India & Anr. v. M. Siddaraj [Civil Appeal No. 3933/2023], Mr. Pramod Gupta, learned counsel for the respondent, submits that the petitioner is entitled to enhanced pension on the basis of the notional increment with effect from 01.05.2023. Mr. Prakash Khandelwal, learned counsel for the petitioner, states, upon instructions, that this position is acceptable to the petitioner also. 4.
The writ petition is, therefore, disposed of with the direction that the petitioner's pension, with effect from 01.05.2023, will be recomputed on the basis of the notional increment above. 5.
Arrears be disbursed within eight weeks from today.
