By way of this writ petition, the petitioner, who is an employee of the respondent - Jawaharlal Nehru University ["JNU"], seeks a direction to transition from the Contributory Provident Fund-cum-Gratuity Scheme to the General Provident Fund-cum-Pension-cum-Gratuity Scheme. 2.
Pursuant to the order dated 07.07.2025, Mr. Karan Prakash, learned counsel for JNU, submits that the relief sought by the petitioner is covered by the judgment of this Court in Manoj Pant & Ors. v. Jawaharlal Nehru University, [2022 SCC OnLine Del 520, decided on 18.02.2022], as affirmed by the Division Bench in JNU v. Manoj Pant & Ors., [2022 SCC Online Del 4887, decided on 27.07.2022]. By order dt. 10.04.2024, SLP (C) 19576/2022, against the judgment of the Division Bench, was also dismissed.

In these circumstances, the writ petition is allowed, and the respondent is directed to permit the petitioner to transition from the Contributory Provident Fund-cum-Gratuity Scheme to the General Provident Fund-cum-Pension-cum-Gratuity Scheme. 4.
Learned counsel are ad-idem that this would be subject to the petitioner refunding the amount received by her towards the Contributory Provident Fund-cum-Gratuity Scheme. The petitioner has, in fact, already undertaken to do so.
