O R D E R

By way of the present petition, the petitioner seeks parole. 2.

It is not disputed that the petitioner, pursuant to the incident of re-arrest in the year 2020, was granted the benefit of parole by this Court by order dated 14.09.2023 in W.P.(CRL) 753/2023.

It is pointed out by the learned Standing Counsel that the fact that the petitioner while on parole on an earlier occasion, had committed an offence which had led to his re-arrest, was not brought to the knowledge of this Court.

Be that as it may, concededly the petitioner had been released on parole on multiple occasions and even after he allegedly committed an offence after being released on parole, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

the benefit of parole was granted by this Court by order dated 14.09.2023 and he is stated not to have misused the said liberty. 5.

No other impediment has been pointed out in regard to the petitioner being granted the benefit of parole. 6.

In view of the above, the present petition is allowed. The petitioner is directed to be released on first spell of furlough in FIR No. 94/2001 for the current sentence year for a period of four weeks on furnishing a personal bond in the sum of Rs.15,000/- (Rupees Twenty-Five Thousand Only) each with 02 sureties in the like amount from a family member/friend with no criminal record, to the satisfaction of the Jail Superintendent, and further subject to the following conditions:- i.

The petitioner shall not leave the State of NCT of Delhi without permission of the court and shall ordinarily reside at the address as per prison records/ as mentioned in the present petition;

ii.

The petitioner shall furnish to the S.H.O., P.S: Palam Airport, Delhi his cell-phone number as also the mobile numbers of the two sureties on which the petitioner/sureties may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;

iii.

If the petitioner has a passport, he shall surrender the same to the Jail Superintendent;

iv.

The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice any pending proceedings;

v.

Upon expiry of the period of four weeks of parole, the petitioner shall surrender before the Jail The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Superintendent on or before 04:00 PM.

A copy of this order be sent to the concerned Jail Superintendent for information and compliance forthwith. 8.
