The present petition filed under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 482 of the Code of Criminal Procedure, 1973) seeks grant of parole for a period of 60 days. The Petitioner convicted in proceedings arising from FIR No. 248/2010 registered under Sections 365/376(2)(g)/506/34 of the Indian Penal Code, 1860 at P.S. Dhaula Kuan and currently serving the sentence awarded to him. 2.

The Petitioner seeks grant of parole on account of the medical condition of his ailing mother. The medical record relating to the Petitioner's mother, has been verified by the State, confirming that she is scheduled for surgery on 14th July, 2025.

was convicted. He further notes that the Petitioner was recently granted furlough and that the mandatory one-month interval between the date of surrender from the last furlough, as required under Rule 1212 of the Delhi Prison Rules, 2018, has not lapsed.

The Court has considered the afore-noted facts and submissions. As per the latest Nominal Roll, as on 10th July, 2025, the Petitioner has been in custody for 13 years, 8 months, 26 days and earned remission of 2 years, 9 months and 15 days. The jail conduct of the Petitioner for the last one year and the overall jail conduct is satisfactory. 5.

Considering the Petitioner's weak economic situation and the verified medical report of his mother, the Court, in light of the specific circumstances of this case, is inclined to grant the Petitioner's request for parole.

Accordingly, the petition is allowed and the Petitioner is directed to be released for a period of four weeks, from the date of his release, on his furnishing a personal bond in the sum of INR 10,000/- with one surety in the like amount to the satisfaction of the concerned Jail Superintendent, subject to the following conditions:

(i) The Petitioner shall report to the concerned SHO(s) once a week on every Monday during the period of parole;

(ii) The Petitioner shall furnish his telephone number to the SHO(s) concerned, which the Petitioner will keep operational at all times; (iii) The Petitioner shall surrender before the Jail Authorities at the expiry of the period of parole;

(iv) The Petitioner shall not commit any offence during the period of his release.
