Application stands disposed of.

CRL.M.A. 10429/2025 (MODIFICATION AND RELAXATION IN BAIL CONDITIONS) 1.

This is application under Section 528 BNSS,2023 filed on behalf of the petitioner for modification and further relaxation of bail conditions imposed by this Court vide judgment dated 30.08.2024 which were partly relaxed vide order dated 24.10.2024.

Vide judgment dated 30.08.2024, this Court had granted bail to the petitioner imposing the following conditions:- The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

a) The Petitioner shall furnish security in the sum of ₹1,00,000/- with two sureties of the like amount to the satisfaction of the Trial Court/Magistrate/Duty Magistrate.

b) The Memo of Parties indicates that the Petitioner is residing at R/o KG-1/79, Vikas Puri, Delhi. The Petitioner is directed to reside at the said address and she is directed not to move at her Flat No.201, County Homes, Sector-64, Medawas, Gurugram, Haryana where the co-accused persons were residing.

c) The Petitioner shall not leave NCT of Delhi without prior permission of the concerned Court.

d) The Petitioner is directed to attend all the proceedings before the Trial Court.

e) The Petitioner shall report to the concerned Police Station every Monday, Wednesday and Friday at 10:00 AM and she should be released after completing all the formalities within an hour. f) The Petitioner is directed to give all her mobile numbers to the Investigating Officer and keep them operational at all times. g) The Petitioner is directed not to tamper with evidence. h) The Petitioner is directed to deposit her passport with the Trial Court. i) Violation of any of these conditions will result in the cancellation of the bail given to the petitioner."

A similar application being CRL M. A. 29883/2024 for modification /relaxation of condition no. (b) & (e) was filed earlier and vide order dated 04.10.2024, this Court had modified condition no. (e), but declined to modify condition no. (b).

Learned counsel for the petitioner submits that there has been change of circumstance in as much as certain thefts have taken place at Flat No.201, County Homes, Sector-64, Medawas, Gurugram because of the reason that the house is lying unoccupied.

Learned APP for State has made request that this application be placed before the bench of Hon'ble Mr. Justice Subramonium Prasad who disposed of a similar application vide order dated 04.10.2024. 6.

This Court is of the opinion that it may not be prudent for this Court to consider this application, once similar request made before the previous bench has already been rejected. As such, this application be placed before Hon'ble Mr. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
