By way of the present writ petition, the petitioner who claimed to be a subsequent purchaser and neither arrayed as an accused person nor as a victim in the subject FIR, is aggrieved by the impugned order dated 28.04.2023 vide which the petitioner's application seeking release of the property i.e., Land admeasuring 100.332 sq. m. forming part of Chak No. 680, Khasra No. 899, Khasra No. 900 and Khasra No. 908/3 (Private Plot No. 203, Sector-2) situated at Village Baldhedi Rajputan, Pargana, Tehsil, Rookie, District Haridwar has been dismissed. 2.

Learned ASC for the State, on instructions, submits that the earlier order dated 09.12.2009 (wrongly mentioned as 10.12.2009) was not traceable. He submits that now the order has been traced in pursuance to directions passed by this Court.
