CRL.M.C. No. 578/2016 1.

Vide the instant petition, the petitioner seeks directions thereby seeking quashing of the NBWs issued against him by the learned Metropolitan Magistrate, vide its order dated 19.01.2016 in case bearing FIR No.515/2014 registered with Police Station Dwarka, Delhi, for the offence punishable under Section 24 of the Arms Act, 1959. 2.

It is admitted that for the aforesaid relief, the petitioner has filed an application, wherein vide order dated 25.01.2016 the learned Magistrate

directed the Investigating Officer to verify the facts of the fire incident and accordingly, listed the matter for 25.02.2016. 3.

Since the application of the petitioner is already pending, the present petition is not maintainable. However, the Investigating Officer is directed not to take coercive steps against the petitioner till his application pending before the learned Trial Court is decided.

In view of the above, the present petition stands disposed of. 5.

A copy of this order be given dasti to the learned counsel for the parties under the signature of the Court Master. Crl.M.A. No.2413/2016 (for stay) With the disposal of the petition noted above, the instant application has become infructuous. The same is dismissed accordingly. SURESH KAIT, J.
