Learned counsel for the plaintiff prays for withdrawal of the suit. Though this Court would not have pecuniary jurisdiction to entertain this application but since the suit is being withdrawn, I exercise my powers under Section 24 of Code of Civil Procedure, 1908 (CPC) read with Article 227 of the Constitution of India to retain the suit so that it is allowed to be withdrawn, as prayed.
