% 06.02.2017 This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioners for quashing of FIR No.159/2015, under Sections 354-D IPC registered at Police Station Chandni Mahal, Delhi and all proceedings arising therefrom.
Counsel for the petitioners submits that the petitioner No.1 Mohd. Asad @ Arshad is the relative of the respondent No.2/complainant, Ms.Rafat and the petitioners No.2 and 3 are the friends of the petitioner No.1. Counsel for the petitioners further submits that due to the misunderstanding arisen between the parties, the respondent No.2/complainant Ms.Rafat got registered an FIR No.159/2015, under Sections 354-D IPC at Police Station Chandni Mahal, Delhi. Counsel further submits that after the registration of the FIR, the near relatives and the friends intervened and the matter has been amicably settled between the parties and the same has been reduced into writing before the Mediation
Centre, Tis Hazari Courts, Delhi on 12th January, 2017. Counsel for the petitioners further submits that since the matter has been amicably settled between the parties and nothing remains to be adjudicated further between them and since the petitioner No.1 and the respondent No.2 are near relatives, to have better relationship between them in near future, the present FIR, which is coming as a hurdle to lead peaceful life in future, may be quashed.
The respondent No.2/complainant is present in Court today and has been identified by the Investigating Officer Sub Inspector M.K.Khan, P.S. Chandni Mahal, Delhi. The respondent No.2/complainant admits that the petitioner No.1 is her brother-in-law and further admits that she has entered into amicable settlement with the petitioners voluntarily and without any force, pressure or coercion. She further admits that nothing further remains to be adjudicated between the parties and submits that she has no objection if the aforesaid FIR is quashed.
Looking into the above facts and circumstances, since the matter has been amicably settled between the parties and the dispute pertains to the family relations of petitioner No.1 and respondent No.2 and nothing further remains to be adjudicated between them, to have better relationship in near future, I deem it appropriate to quash the FIR and all its subsequent proceedings.
Consequent, FIR No.159/2015, under Sections 354-D IPC registered at Police Station Chandni Mahal, Delhi and all proceedings arising therefrom are hereby quashed.
